Michigan Sports Betting and the Law
You may be wondering how all of this is possible now. As it turns out, Gov. Gretchen Whitmer’s 2019 signature on the Lawful Sports Betting Act opened the door to an influx of sports betting interests in the state.
The signature did not come easy, as Whitmer sparred with legislators over the contents of the bill. However, in the end, the governor decided that allowing sports betting would be a boon to the classroom students and ailing firefighters in the state.
As signed, the bill allowed for several key initiatives. Chief among them was the inclusion of online sports betting, of course. However, there were several other relevant details in the law, including:
- All 26 casinos (3 commercial, 23 tribal) are able to apply for both retail and online sports betting.
- The initial fees for application and licensing are $50,000 and $100,000, respectively. The books must renew their licenses annually, at a cost of $50,000.
- Sports betting gross receipts are taxed at a rate of 8.4%. The three commercial casinos must also pay a 1.5% city tax to Detroit.
- Unusually, sportsbooks can deduct a portion of their taxes if they give away free play to patrons.
- The books can only use a single sports betting platform online.
- Official league data is required for live betting UNLESS the operators can argue to the Michigan Gaming Control Board that data rates make operations unviable.
At the same time that she signed the Lawful Sports Betting Act, Whitmer also signed off on a host of other gambling expansion bills. Notably, Michigan will soon be home to both online casino gambling and online poker play.
